The recruitment industry’s had to get to grips with several new pieces of legislation in recent years – most notably the introduction of the onshore intermediaries rules in April 2014.
As a recruiter, the legislation means that you could be liable for paying the employment taxes of any contractor you supply, unless this is carried out by a third party (such as an umbrella company). In these cases, you’ll need to provide HMRC with additional information on a quarterly basis.
- Full name
- Address & postcode
- National Insurance number (if they have one and their date of birth & gender are unknown)
- Date of birth and gender (if they don’t have a National Insurance number)
In addition, you must tell them the reason why you don’t operate PAYE on the worker’s behalf. You should also include the:
- Start date of work with the client
- End date of work with the client (if applicable)
Payment details do not need to be supplied as they’ll already have been included in the umbrella company’s Real Time Information (RTI) submission.
If your reports are late, incomplete or incorrect, you could face heavy financial penalties. This means that you need to have all the information at your fingertips, ready to pass on to HMRC by the deadline.
